11. Agreement to These Terms

These Terms and Conditions (“Terms”) are an agreement between you and Mendez Career Consulting Group, LLC (“MCCG,” “we,” “us,” or “our”). They govern your use of MendezCareerConsulting.com, the MCCG Interview Pressure Test, the MCCG Client Portal, and our other online tools and resources.

By using our website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.

Paid services may also be covered by a separate written agreement, invoice, or purchase terms. If a separate agreement conflicts with these Terms, the separate agreement controls for that service.

22. Eligibility

You must be at least 18 years old to use our website, the Interview Pressure Test, the Client Portal, or our services.

MCCG provides career consulting and career development services, which may include:

• Résumé strategy and writing
• LinkedIn optimization
• Interview preparation and mock interviews
• Career strategy and career change positioning
• Job search education, resources, and tools

44. MCCG Is Not an Employment Agency

MCCG is a career consulting and coaching business. MCCG is not an employment agency, staffing firm, or recruiter for any employer. MCCG does not place people in jobs, does not guarantee placement, and does not charge any fee for getting you a job. Any job openings we share with you are for information only. You decide whether to apply, you apply directly to the employer, and the employer makes all hiring decisions.

55. No Guarantee of Results

MCCG provides career strategy, coaching, preparation, and professional services. We do not guarantee interviews, job offers, hires, promotions, compensation increases, placements, job retention, or any other specific result. Individual results vary based on experience, market conditions, participation, employer decisions, and other factors outside MCCG’s control.

66. Interview Pressure Test

The MCCG Interview Pressure Test is an educational career coaching tool. Your results are coaching observations based on your answers. They are not scientifically validated, are not a psychological, medical, or diagnostic assessment, and do not predict whether you will be hired. The Pressure Test is not employment screening, and MCCG does not share your answers or results with employers.

MCCG may refuse or cancel any code obtained through false information, duplicate or automated submissions, or any other violation of these Terms.

77. Gift Certificates

Gift certificates purchased from MCCG are subject to the terms shown at the time of purchase. Purchased gift certificates will not expire earlier than five years from the date they are issued and do not carry dormancy, inactivity, or service fees. Gift certificates are not redeemable for cash except where the law requires it. Free promotional discount codes, including Pressure Test codes, are not gift certificates.

88. Your Information and Responsibilities

You are responsible for giving us accurate and truthful information about your work history, education, accomplishments, skills, and background. MCCG helps organize, clarify, and present your information, but we will not knowingly include false or misleading information in your materials, and we may decline to include anything we believe is inaccurate.

You are responsible for reviewing all final materials before you use them, and for the information you submit to employers and others.

Do not share confidential information that belongs to a current or former employer unless you have the right to share it.

99. Accounts and Client Portal

Some features require an MCCG account or Client Portal access. You are responsible for keeping your login information private, giving accurate account information, and all activity under your account. Do not attempt to access another client’s information. Tell us right away if you believe your account has been accessed without permission.

1010. Acceptable Use

You may use our website and resources for lawful personal and business purposes. You may not:

• Attempt to gain unauthorized access to the website, the Client Portal, or our systems
• Attempt to bypass or test our security
• Interfere with or disrupt the website
• Upload viruses or other harmful code
• Use bots, scrapers, or other automated tools to access, copy, or overload the website
• Copy, reverse engineer, or attempt to extract the Interview Pressure Test questions, scoring, or results logic
• Submit false information, use another person’s identity, or create multiple submissions to obtain discount codes
• Use our website or services for any unlawful or fraudulent purpose

1111. Intellectual Property

MCCG owns or licenses the content on our website and in our services, including our name, logo, branding, designs, written materials, the Interview Pressure Test and its questions and scoring, worksheets, training materials, templates, graphics, and tools.

You may use MCCG materials only for your own personal career purposes. You may not copy, republish, sell, distribute, or use them for commercial purposes or to create competing products or services without our written permission.

1212. Your Materials

You keep ownership of the personal career information and original materials you give us. You give MCCG permission to use them as reasonably needed to provide the services you requested.

Once you have paid in full, you may use the final résumé, LinkedIn content, and other career materials we prepare for you for your own career purposes. MCCG keeps ownership of its templates, methods, frameworks, and tools.

1313. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information. It is part of these Terms.

1414. Electronic Communications

By using our website or services, you agree that we may communicate with you electronically, including by email and through the Client Portal, and that electronic communications satisfy any legal requirement that a communication be in writing. Marketing emails require your consent and you may opt out at any time. Marketing text messages require your separate express written consent.

1515. Third-Party Services and Links

Our website may link to or use services from other companies, such as job boards, Google services, LinkedIn, payment processors, and scheduling tools. MCCG does not control these companies and is not responsible for their content, policies, security, availability, or hiring decisions.

1616. Professional Disclaimer

MCCG provides career consulting and educational services. Information on our website is general in nature unless MCCG has been engaged to provide individual services to you. MCCG is not a law firm and does not provide legal, tax, financial, immigration, medical, or mental health advice.

1717. Disclaimer of Warranties

Our website, the Interview Pressure Test, and our free resources are provided “as is” and “as available.” To the fullest extent permitted by law, MCCG disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website or any tool will always be available, uninterrupted, error-free, or free of harmful code.

1818. Limitation of Liability

To the fullest extent permitted by law:

• MCCG will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost wages, lost job opportunities, lost profits, or lost data.
• MCCG’s total liability for any claim arising from the website, the Interview Pressure Test, or free resources will not exceed one hundred dollars ($100).
• MCCG’s total liability for any claim arising from a paid service will not exceed the amount you paid MCCG for that service in the 12 months before the claim arose.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

1919. Indemnification

You agree to defend, indemnify, and hold harmless MCCG and its owner from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the website or services, your violation of these Terms, or false or unauthorized information you provide.

2020. Suspension or Termination

MCCG may suspend or end your access to the website, Client Portal, or discount codes when reasonably necessary because of misuse, fraud, security concerns, unauthorized access, violation of these Terms, or unlawful activity.

2121. Governing Law, Disputes, and Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules.

If you have a concern or dispute, please contact us first at Saul@MendezCareerConsulting.com. We will try in good faith to resolve it informally within 30 days.

If a dispute is not resolved informally, it will be brought only in the state or federal courts located in Cook County, Illinois, and you and MCCG agree to the jurisdiction of those courts.

2222. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Changes apply from the new effective date forward and do not apply to disputes that arose before the change. Continued use of the website after the effective date means you accept the updated Terms.

2323. General

These Terms, our Privacy Policy, and any separate written agreement for a paid service are the entire agreement between you and MCCG about their subject. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms. MCCG may transfer its rights in connection with a sale, merger, or reorganization of the business. Section headings are for convenience only.
